DEFINITIONS

Local copy - A copy of the work stored by the user or a system controlled by the user on a local off-line medium such as a fixed or removable disk, irrespective of the purpose for which the copy is made, and including archival copies.

Work - Any original expression of any idea as protected by the international laws of copyright under the Berne Convention and local Copyright laws such as the United States Copyright Act (Title17).

Owner - The creator of the work, his/her heirs or assigns or any other persons to whom his/her copyright has been lawfully transferred.

Student - Currently enrolled student at an educational institution.

Private Individuals - A natural person who is responsible for paying his own internet access account, who has no commercial interests in any business that uses the internet, who does not access the internet as part of his/her employment and who is not engaged in any form or commercial activity apart from buying access time and goods and services from others on the internet.

Educational Institutions - Faculty member or staff member of an educational institution (K-12, junior college, college or library).

Charitable Institutions - An employee of an organization which meets the copyright owners' criteria for a charitable non-profit organization. Government agencies (other than public libraries) are not considered educational or charitable non-profit organizations for purposes of this Agreement.

Commercial Individuals - Any natural person who is not a student, a private individual or a member of an educational or charitable institution.

Commercial Organizations - Any body that is not a charitable or an educational institution.

Printed copy - A reproduction, adaptation or version of the work created through any mechanical process whereby a visible representation of the work is generated on any medium whatsoever except that made through normal browser-based onscreen display of the work.

International Treaties - Agreements between signatory countries, in particular the Berne Convention, that ensure that a citizen of one country who breaches the intellectual property of a person from another country can be prosecuted by that person under the relevant local intellectual property laws.

Disclaimer of Warranty

The Copyright is provided on an "AS IS" basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the work is borne by you. Should the work prove defective, you and not the owner assume the entire cost of any service and repair. Title

Assignment

Restricted Rights

Use, duplication or disclosure by the U.S. Government is subject to restrictions as set out in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software Restricted Rights at 48 CFR 52.227-19.
